The use of the picksea.com website is governed by the present general conditions. By using the site, you acknowledge having read these conditions and having accepted them. These conditions can be modified without notice by NAUTING SAS.
The following General Conditions of Use describe the conditions according to which the company NAUTING SAS under the commercial brand PICKSEA, hereinafter referred to as "PICKSEA ", "Picksea.com" or "us", proposes the access to its services.
These Terms and Conditions define the conditions of your use of our services on the website www.picksea.com, by clicking on the "I accept" button during the validation of your order, you confirm to accept all the stipulations of these Terms and Conditions. If you do not accept these Terms and Conditions, you will not be able to use our services.
As soon as you validate your registration on our website www.picksea.com, you agree to respect all the terms and conditions herein. If you have any questions that you do not find answered, you can send us an email via our contact form
Our services are reserved for persons legally capable of entering into contracts under French law. When you register, you acknowledge that you have read the general conditions of sale. The registration on picksea.com requires the full acceptance of the general conditions of sale. From the confirmation of your registration on picksea.com, you can buy and access your space on our site. The elements necessary for the validation of your registration are your name, first name, address and email address.
Unless otherwise stated, our final prices will be payable in Euros only. Our prices are without obligation, subject to stock availability. The valid prices are those indicated at the time of the order as they appear on our site (except for errors or omissions). Our site is updated automatically after each sale.
Picksea.com is responsible for the correct description of the products presented on its website (authenticity and condition of the products). The pictures shown on the website correspond to the product you will receive. You can decide to implement the guarantee against the hidden defects of the sold good and choose between the resolution of the sale or a reduction of the selling price. However the products of decoration in recycled sailcloth are unique products where the photo presented is a generic photo, it is possible that the product received presents some differences of color and general aspect. The description of the products does not engage the responsibility of Picksea for the comments, reviews and descriptions.
Picksea.com reserves the ownership of the goods until full payment is received, in accordance with the terms of the law n°80-336 of May1st 1980, relating to the reservation of ownership. No reservation will be taken into account.
Full payment of your order
The full payment of the products is made "with the order": it is compulsory for any order whose amount is lower than 100 € TTC. For any order over 100 € including VAT, you can choose to pay in full or in 3 or 4 times via Oney Bank
The payment of your order is made by credit card either on the Payplug platform or on your Paypal account: as soon as your payment is confirmed by your bank via the verification system it has set up, your order is immediately confirmed. If you prefer to pay by bank transfer, your order will be confirmed upon receipt of your payment.
Secure payment by credit card with 3D Secure
Payments by credit card over 30€ are authenticated thanks to the 3-D Secure system. After validation of your bank details, you will receive a notification on your bank's application. You will then be able to identify yourself using a password or your fingerprint. Once the authentication is validated, your order is finalized: you will receive a confirmation e-mail. For any question concerning the 3-D Secure, we invite you to contact your bank directly.
Payment of your order in 3 or 4 times by credit card from 100€ to 3000€ with Oney Bank
Our partner Oney Bank offers you a financing solution called 3x 4x Oney, which allows you to pay for your purchases from €100 to €3000 in 3 or 4 times with your bank card.
Conditions: This offer is reserved for individuals (natural persons of legal age) residing in France and holding a Visa or MasterCard bank card with a validity date greater than the duration of the chosen financing. Cards with systematic authorisation such as Electron, Maestro, Nickel, etc., as well as e-cards, Indigo and American Express cards are not accepted.
How to subscribe: After completing your order, simply click on the "Payment in 3x 4x Oney by credit card" button. You will then be redirected to our partner's 3x 4x Oney web page, where you will find a detailed summary of your order and a personalized financing application, which you must then validate. You enter your personal information or, if you have a 3x 4x Oney account, you identify yourself using the login details linked to your 3x 4x Oney account. You read the general terms and conditions of payment in instalments that you wish to subscribe to, which are provided to you in PDF format so that you can read, print and save them before accepting them. You then notify your electronic acceptance by ticking the corresponding box. You acknowledge that the "double click" associated with the checkbox on the acknowledgement of the general conditions is equivalent to consent to contract and constitutes an irrevocable and unreserved acceptance of the general conditions of the product. In the absence of proof to the contrary, the data recorded by Oney Bank shall constitute proof of all transactions between you and Oney Bank. If you apply for a financing solution offered by Oney Bank, the information relating to your order will be transmitted to Oney Bank, which will use it to study your application for the purposes of granting, managing and collecting credit. Oney Bank reserves the right to accept or refuse your request for 3x 4x Oney financing. You have a 14-day cooling-off period to withdraw from your loan.
How does it work? Payment in 3 or 4 instalments by credit card allows you to pay for your order on our website as follows:
- a compulsory deposit, debited on the day of the confirmation of the shipment of your order corresponding to a third or a quarter of the order, to which are added costs corresponding to 1.45% of the total amount of the order for a 3 times and 2.2% for a 4 times (within the limit of 15€ maximum for a payment in 3 times and 30€ maximum for a 4 times) ;
- two or three monthly payments, each corresponding to a third or a quarter of the order, debited 30 and 60 days later for the 3 times and 30, 60 and 90 days later for the 4 times.
The payment in 3 times from 100€ of purchase and up to 3000€
Example: For a purchase of €150, contribution of €52.18 then 2 monthly payments of €50. Credit for a period of 2 months at a fixed APR of 19.26%. Cost of financing: €2.18 up to a maximum of €15.
Payment in 4 instalments from €100 up to €3000
Example: For a purchase of €400, deposit of €108.80 then 3 monthly payments of €100. Credit over 3 months at a fixed APR of 19.31%. Cost of financing: €8.80 up to a maximum of €30.

A- Delivery / Shipping
Picksea.com is committed to ensure the delivery of your products in the best conditions. The products are packaged in appropriate packaging and shipped by one of the available transport methods when you place your order (So Colissimo, Point Relais, UPS, TNT, collection in store in Ploemeur, Geodis Calberson). From Monday to Friday, if your product is in stock, your order is shipped within 24 hours after validation of your payment. The order will be sent to the address indicated by the buyer during the validation of the order. If the product is not in stock, an estimated date of delivery is communicated to you on the page of order and sent by e-mail during the confirmation of order. (see delivery terms according to the chosen carrier)
Make sure that the contact details given at the time of validation are correct and give a mobile phone number so that the delivery person can contact you if necessary. Make sure you are present or represented on the estimated delivery date. Delivery in France takes between 2 and 3 days depending on the destination and the shipping method chosen (Colissimo, Chronopost or carrier for large shipments). For deliveries abroad, delivery times vary depending on the destination.
For all orders over 150€, you benefit from free SoColissimo delivery in metropolitan France and Belgium, except for bulky products: over 20kg or 1.70m long.
B- Problems related to transport
In case of problem upon receipt of your packages you must imperatively check the contents of the package or packages, before signing the transport note. Any anomaly must be indicated on the transport slip, with the exact description of the damaged or missing packages. The anomaly must then be reported by email via our contact form in order to start the compensation procedure by sending us the transport documents. Without any particular indication, Picksea.com or the carrier cannot be held responsible.
TRANSFER OF RISKS
The transfer of risks of deterioration, damage, theft or loss, even by fortuitous event or force majeure, takes effect once the delivery is effective, the customer renouncing by the same on his behalf as well as on that of his assignees to any recourse against the company Nauting. The transfer of risk also applies to any damage caused during the use of the equipment. The actual delivery takes place as soon as the chosen carrier declares that the package has been delivered. In the event of a delivery dispute, recourse must be made to the carrier who declared the delivery effective.
C- Collection point
You also have the possibility of withdrawing your parcels in the nearest point of withdrawal from your home through the service of "Point Retrait Colissimo". With this option you can choose a shop, a tobacconist's or a post office. You can find all the partners when you choose your delivery.
D- Withdrawal on the Showroom of Ploemeur (56 - Lorient)
You also have the possibility of coming to withdraw your products in our showroom in Ploemeur, the withdrawal in shop is always free. Address of withdrawal :

The returned items must be new, unused and in their original box perfectly intact. The return is validated by our services if and only if all these conditions are respected. The return costs are always at the customer's expense except in the following 3 cases:
- Packing error being our responsibility.
- Incorrect description of the product sheet of the ordered item(s).
- Any order delivered in Metropolitan France for an amount greater than 150€ (except for bulky products: greater than 20kg or 1.70m long)
If you are not completely satisfied with the article you have received, you have 30 days from the date of receipt of the parcel to exchange it for another article from our online shop. You are responsible for the return shipping costs (except for exchange requests for orders over 150€ in Metropolitan France and non-bulky products: less than 20kg or 1.70m long). PICKSEA takes care of the shipping costs for the new product(s) chosen only in the case of a change of size or colour.
If the new product(s) desired is (are) not in stock with us and cannot be ordered from our supplier, PICKSEA will issue a credit note in the form of a discount voucher so that you can buy something else from our online shop. PICKSEA is not responsible for the delivery time in the specific case of exchanges.
In case of problem with a product, you will be able to choose between repair or replacement of the good subject to the conditions of cost.
The customer has a period of 14 days from the date of receipt of the goods to withdraw and request a refund. The refund is validated if the returned product(s) respect(s) the conditions described in the paragraph "Return" above and if at least one email of retraction has been sent via our contact form within 14 days of receipt of the package. The refund will be made within 14 days from receipt of the product. If the 14 days of withdrawal is exceeded but not the 30 days, PICKSEA undertakes to establish a credit note in the form of a voucher to the customer so that the latter can buy other products of equal or greater value than the first article (s) ordered (s). In the latter case, it is up to the customer to pay the difference.
The present General Conditions are governed and interpreted in accordance with French law. The French courts will have jurisdiction to rule on all disputes that may arise between the parties relating to the execution of these Terms and Conditions.
In the event of a dispute with Nauting, the Customer may have recourse to the service of the State-approved consumer mediator for the sector to which Nauting belongs:

A- Exception, force majeure
We do not guarantee that the operation of our services will be uninterrupted, error-free or secure. We reserve the right to limit the activity of our site from time to time or permanently, without prior notice to our customers.
We shall not be liable for any failure to comply with our obligations under these Terms and Conditions due to events beyond our control and/or resulting from force majeure.
Cases of force majeure include, in addition to cases recognized by jurisprudence, all natural disasters, all acts of war, attacks on public order, epidemics, fires, floods and other disasters, all governmental acts, all strikes, lockouts, as well as all electrical and technical problems external to the parties preventing communications.
B- Personal data protection policy
PICKSEA commits itself to respect the confidentiality of the information provided by the buyer, these being exclusively reserved to PICKSEA and NAUTING. In accordance with the article 27 of the law N°78-17 of January 6th, 1978 (hereafter "LIL") and with the general Regulation (EU) on the protection of the data of April 27th, 2016 (hereafter "RGPD"), the purchaser is free to proceed to the rectification or to the definitive deletion of his personal information by simple request by mail (PICKSEA 16 rue Jean Moulin 56270 Ploemeur) or by mail on our form of contact.
Collection of data
When placing an order or subscribing to the Picksea newsletter, the User communicates certain Personal Data. If the User does not wish to provide the information requested, the User may not be able to access certain parts of the Site or the Application, and PICKSEA may not be able to respond to the User's request.
A- Purpose of the collection of personal data
The collection of your Personal Data has as its legal basis:
- PICKSEA 's legitimate interest in ensuring the best quality of its services, in providing its Users with the best possible follow-up of their purchases, and in improving the functioning of its Website and Application
- the legitimate interest of PICKSEA to carry out optional satisfaction surveys on its services in order to improve them
- the consent of its Users when this is required by the regulations in force, in particular with regard to commercial prospecting and cookies.
The data of the Users of PICKSEA is mainly processed to :

- Password, pseudonym, order history, history of favourite searches, messages exchanged with customer service
PICKSEA is likely to process, as a Data Controller, all or part of the following data:
- to enable browsing on the Site or use of the Application: connection and usage data of the Site or the Application
- to prevent and fight against computer fraud (spamming, hacking...): computer equipment used for browsing, IP address, password (hashed)
- to improve navigation on the Site or the use of the Application: connection and usage data
- to conduct optional satisfaction surveys on PICKSEA: email address
- to conduct communication campaigns (sms, email): telephone number, email address.
C- Non disclosure of personal data
The User's Personal Data are not transmitted to commercial or advertising actors.
The User's Personal Data may be processed by subcontractors (service providers), in full compliance with the principle stated above, exclusively in order to achieve the purposes of this policy.
Within the limits of their respective attributions and for the purposes mentioned above, the main persons who may have access to the data of the Users of PICKSEA are mainly the agents of our customer service and our commercial team.
PICKSEA also uses the services provided by several specialized companies (mailing, audience analysis), the list of which can be communicated to the persons concerned on request by our contact form
D- Duration of data retention
We only keep your data for the time necessary for the purposes pursued, in accordance with legal requirements.
E- Users' rights
In accordance with the European regulations in force, the Users of PICKSEA have the following rights:
- right of access (Article 15 RGPD) and rectification (Article 16 RGPD), update, completeness of Users' data
- the right to block or delete Users' personal data (article 17 RGPD), when they are inaccurate, incomplete, ambiguous, outdated, or whose collection, use, communication or storage is prohibited
- right to withdraw consent at any time (Article 13-2c RGPD) - right to limit the processing of Users' data (Article 18 RGPD)
- right to object to the processing of Users' data (Article 21 GDPR)
